Conclude readmission agreement with Netherlands Somalia (10/06/1911)
From a letter from the Department of Legal representation of the IND has shown that on May 3, 2010 a readmission agreement concluded between the Netherlands and the Transitional Federal Government (TFG) of Somalia. As a result expected in early June with the IND forced return to Mogadishu / Somalia to begin.
The letter of May 19, 2010 of the IND to the Hague Tribunal (parallel session in Amsterdam, Netherlands) is that this is due to the consent of the Minister of Justice with forced return to Somalia / Mogadishu from about February / March 2010. Furthermore, the letter stated that in order to effectuate the return, again by DT & T with all partners will be discussed. Expected by the IND will then start in June 2010 commenced may be forced return to Somalia / Mogadishu.
Forced return to Somalia at this time given the security situation in Somalia and particularly the region around Mogadishu are wholly unacceptable. Respected human rights organizations like Amnesty International and Human Rights Watch indicate that the situation around Mogadishu is terrible. It is also well known that the TFG (strangely enough by the IND also marked Temporary Federal Government …) only parts of Mogadishu and holds that it can offer no protection to citizens against the violence of the Al-Shabaab, an Islamic terrorist organization that considerable havoc in Somalia. The High Commissioner for Refugees United Nations (UNHCR) indicates forced return to central and southern Somalia are not acceptable.
Recently the IND even by the State Council on the fingers tapped on the rejection of an asylum application from an applicant who is from Mogadishu. The Council of State considered that the IND had not sufficiently investigated whether the security situation around Mogadishu is not so bad that the applicant for a status should be provided. INLIA extent known, in this case, no final decision. In other words, the highest court in The Netherlands is in the case of a Somali asylum seeker that the situation in Mogadishu really unsafe, despite Justice will now proceed to the release of other asylum seekers to Mogadishu. INLIA considers this practice totally unacceptable.
It is also very strange that Justice now Somalis want to expand on the basis of agreement with the TFG, while the IND under regular procedures, no identity document from Somalia accepts because there is no central government would be empowered to make legal documents to provide

Nederland sluit terugkeerovereenkomst met Somalië (11-06-10)
Uit een brief van de afdeling Procesvertegenwoordiging van de IND is gebleken dat er op 3 mei 2010 een terugkeerovereenkomst is gesloten tussen Nederland en de Transitional Federal Government (TFG) van Somalië. Als gevolg daarvan verwacht de IND begin juni met gedwongen terugkeer naar Mogadishu/Somalië te kunnen beginnen.
In de brief van 19 mei 2010 van de IND aan de Rechtbank Den Haag (nevenzittingsplaats Amsterdam) staat dat dit het gevolg is van de instemming van de minister van Justitie met gedwongen terugkeer naar Somalië/Mogadishu van omstreeks februari/maart 2010. Verder staat in de brief vermeld dat, om de terugkeer te kunnen effectueren, er nogmaals door de DT&V met alle partners gesproken zal moeten worden. Naar verwachting van de IND zal er dan begin juni 2010 een aanvang genomen kunnen worden met gedwongen terugkeer naar Somalië/Mogadishu.
Gedwongen terugkeer naar Somalië is op dit moment gezien de veiligheidssituatie in Somalië en dan met name de regio rond Mogadishu echter volstrekt onacceptabel. Gerespecteerde mensenrechtenorganisaties zoals Amnesty International en Human Rights Watch geven aan dat de situatie rondom Mogadishu verschrikkelijk is. Ook is algemeen bekend dat de TFG (vreemd genoeg door de IND overigens aangeduid met Temporary Federal Government…) slechts delen van Mogadishu in handen heeft en dat zij geen bescherming kan bieden aan burgers tegen het geweld van de Al-Shabaab, een terroristische islamitische organisatie die flink huishoudt in Somalië. Ook het Hoge Commissariaat voor de Vluchtelingen van de Verenigde Naties (UNHCR) geeft aan gedwongen terugkeer naar Centraal- en Zuid-Somalië niet acceptabel te vinden.
Onlangs werd de IND nog door de Raad van State op de vingers getikt over het afwijzen van een asielaanvraag van een asielzoeker die afkomstig is uit Mogadishu. De Raad van State vond dat de IND onvoldoende had onderzocht of de veiligheidssituatie rondom Mogadishu niet dusdanig slecht was dat aan de betreffende asielzoeker een status zou moeten worden verstrekt. Voorzover INLIA bekend, is er in deze zaak nog geen definitieve beslissing genomen. Met andere woorden: de hoogste rechter in Nederland geeft in de zaak van een Somalische asielzoeker aan dat de situatie in Mogadishu toch echt onveilig is; desondanks wil Justitie ondertussen overgaan tot het uitzetten van andere asielzoekers naar Mogadishu. INLIA acht deze handelswijze volstrekt onacceptabel.
Daarnaast is het bijzonder vreemd dat Justitie nu Somaliërs wil uitzetten op basis van afspraken met de TFG, terwijl de IND in het kader van reguliere procedures geen enkel identiteitsdocument uit Somalië accepteert, omdat er geen centrale overheid zou zijn die bevoegd is om rechtsgeldige documenten te verstrekken.
Waarschijnlijk worden over deze kwestie binnenkort Kamervragen gesteld.
